According to journalist Eleanor Terrett, the litigation between Ripple and the SEC may soon reach a final resolution. Both parties are continuing negotiations aimed at achieving a mutually beneficial settlement.

Ripple's Arguments Against the Fine

Ripple argues that the fine is unfair, especially if the new SEC leadership is rolling back enforcement actions against crypto firms. Accepting the decision would amount to an admission of guilt. The SEC has yet to take a firm stance on the issue.

Comments by Eleanor Terrett

Eleanor Terrett said the following on the matter:

‘My understanding is that the delay in reaching a settlement is due to Ripple’s legal team negotiating more favorable terms regarding the August district court ruling that fined the company $125 million and included a permanent injunction preventing the company from selling XRP to institutional investors. The argument I was told was that if the new SEC administration is clearing the sanctions list for all previously targeted crypto firms because it believes regulatory clarity will solve the fundamental problem, why should Ripple still be penalized? Accepting the Torres decision at face value would mean that Ripple has essentially admitted to wrongdoing, but now the SEC itself seems unsure whether it did any wrongdoing.’Eleanor Terrett
