Artur Schaback's Legal Troubles at Paxful
Artur Schaback, one of the co-founders and former Chief Technology Officer (CTO) of Paxful, is facing the possibility of a five-year prison sentence. This situation arose after he confessed to the failure to enforce crucial Anti-Money Laundering (AML) protocols at the cryptocurrency exchange.
The US Justice Department disclosed that Schaback is scheduled for sentencing on November 4, subsequent to his admission of guilt on July 8. As part of his plea agreement, Schaback is required to pay a $5 million fine in three separate installments: $1 million immediately, $3 million by the sentencing date, and the remaining $1 million over the following two years. Furthermore, he will be resigning from his position on Paxful's board.
The prosecutors highlighted that both Schanback and Paxful's former CEO failed to establish the essential AML program mandated within the initial 90 days of the exchange's operation, as prescribed by the Bank Secrecy Act. Additionally, they neglected to institute a Know Your Customer (KYC) process for verifying the identities of users.
This oversight created an opportunity for Paxful to be exploited for illicit purposes, including money laundering, during the period from July 2015 to June 2019.
Schaback and his associate permitted trading on the platform without adequate user verification while misleadingly promoting Paxful as a platform that did not require KYC procedures.
