Ex Populus, the developer of the Xai blockchain, has filed a lawsuit against Elon Musk’s xAI, claiming trademark infringement and unfair competition amid gaming expansion.
Basis of the Trademark Lawsuit
The lawsuit was filed by Ex Populus following Musk’s announcement in November 2024 about launching a gaming studio under xAI, which led to confusion between the similarly named entities.
Consequences and Backlash
The complaint alleges that xAI has caused significant market confusion, misleading users and damaging the Xai brand.
> According to the filing, users and developers have mistakenly associated xAI and even its chatbot Grok with the Xai blockchain.
Ex Populus further claims that the Xai team has faced significant backlash due to public perception of Musk’s actions and reputation.
Regulatory Response
The lawsuit also alleges that xAI’s lawyers pressured the Xai team to abandon their trademark rights. Meanwhile, the U.S. Patent and Trademark Office (USPTO) has reportedly suspended several of xAI’s trademark applications due to potential confusion.
Ex Populus is seeking a court injunction to prevent xAI from further use of the disputed trademark and financial damages related to the harm done to the Xai brand and business.
