Allegation Against OpenAI's ChatGPT by EU Privacy Watchdog

Apr 29, 2024

The European Center for Digital Rights, known as NOYB, has lodged a complaint against OpenAI, alleging that their AI solution, ChatGPT, is providing users with false information about individuals and the company is unable to correct it. Since the launch of ChatGPT, there has been a surge in the use of the chatbot for various purposes, leading to what NOYB calls "unprecedented AI hype." Despite having a vast amount of training data, there is no guarantee that the information presented by ChatGPT is accurate.

NOYB claims that according to the EU's GDPR legislation, all information relating to individuals must be accurate, valid, and users must have full access to the source of the data. The agency highlighted that ChatGPT violated Article 16 of the GDPR, which grants users the right to request data correction or deletion if the provided data is incorrect. OpenAI openly admitted that it cannot rectify inaccurate information on ChatGPT, which NOYB critiqued as apathetic behavior.

This is not the first time OpenAI has faced allegations from government agencies. In the past, they received a cautionary notice from Japan's Privacy Authority over data collection practices and were subpoenaed by the US SEC for internal records. These incidents have raised concerns over OpenAI's approach to data accuracy and user privacy.
