A recent law has been put into action in the UK, granting the National Crime Agency and law enforcement the power to take, freeze, and dispose of cryptocurrency assets.

The UK government declared on Friday that new measures have been implemented to seize crypto assets utilized by criminals. These new powers give the National Crime Agency and police enhanced abilities to confiscate, freeze, and eliminate crypto assets employed by criminals.

The announcement highlights the increasing use of crypto assets by organized criminals to launder illicit proceeds and finance criminal activities. To address this expanding threat, the government modified the legislation relating to proceeds of crime and terrorism, simplifying the process for UK enforcement agencies to investigate, seize, and recover illegal cryptocurrency assets.

One significant change is that police are no longer obligated to make an arrest before seizing crypto assets from suspected individuals. This adjustment makes it easier to confiscate assets obtained through criminal activities, even if perpetrators try to maintain anonymity or are located overseas. Items like passwords or memory sticks that could aid investigations can also be seized by law enforcement.

Law enforcement personnel have been granted the authority to transfer confiscated illegal cryptocurrency assets to a controlled electronic wallet, preventing criminals from accessing these funds. Furthermore, if returning a crypto asset to circulation poses risks to public welfare, authorities can opt to destroy it. Privacy coins, for instance, provide high anonymity levels and are frequently used for money laundering.

Under the new law, victims can request the release of funds from their crypto asset accounts. Recent cases demonstrate the effectiveness of such measures, as law enforcement agencies have seized substantial amounts of cash and crypto assets from criminal operations involving drugs and counterfeits.

Adrian Searle, Director of the National Economic Crime Centre, remarked on the increasing use of crypto assets by criminals and expressed support for the new powers granted to law enforcement for restraining, recovering, and eliminating crypto assets if necessary.
