Yuga Labs secures $1.6M victory in Bored Apes copyright lawsuit

On October 26th, Yuga Labs, the creators of the renowned Bored Ape Yacht Club (BAYC) NFT series, declared that a court has directed two persons who violated its trademark to compensate for damages and halt their unauthorized actions.

After the court ruling against Ryder Ripps and Jeremy Cahen for infringing Yuga Labs’ intellectual property, today they’ve been ordered to cease all sales and marketing … They must pay ($1.575 million) in damages, Yuga’s attorneys’ fees, transfer their fake apes’ smart contract, and relinquish related online assets.The company wrote in a statement

Ripps and Cahen participated in the development of an NFT collection titled RR/BAYC, a mock series that showcased images strikingly similar to the official ones. The RR/BAYC sales page humorously highlighted that "you can't clone an NFT," poking fun at the notion by proving that the actual art can indeed be replicated.

In the aftermath of the recent legal actions, Yuga Labs described this lawsuit as being "distinctly unique" compared to most other copyright infringement cases, citing the defendants' reliance on satire and parody to legitimize their utilization of BAYC trademarks for the imitation collection.

The court now mandates Ripps and Cahen to compensate Yuga Labs a sum nearing $1.575 million. This amount is based on their initial sales revenue of about $1.366 million and subsequent resale earnings of around $117,309.

However, certain allowances will be made for the defendants: they are to hand over a smart contract governing unsold NFTs valued at approximately $106,055. They are also entitled to a reduction of roughly $108,037 due to payments previously made to other associated business entities.

Furthermore, various online domain names will be handed over by Ripps and Cahen to Yuga Labs. They are also prohibited from vending any merchandise associated with the Bored Ape brand. While these stipulations are in place, the RR/BAYC series remains available to the public. The fate of this collection on platforms that currently support it remains uncertain.
